VISA-FREE TRAFFIC:

For persons from third countries, it is possible to enter Poland on the basis of visa-free travel. As part of the visa-free regime, a person with a biometric passport can cross the border.

The total stay in the territory of all Member States of the Schengen area (including Poland) may not exceed 90 days in any 180-day period.

If a person wants to extend the legal stay in Poland without leaving Poland, he / she must submittemporary residence documents (residence card) during the legal stay

However, it must be remembered that during a pandemic, according to the so-called Covid Act, you have the right to submit an application for temporary residence even after 90 days, i.e. your stay will be considered legal, even if you submit temporary residence documents after 90 days of stay.

VISA:

The Polish consul issues two types of visas: Schengen (C) or national (D). To obtain one of them, please contact the appropriate Polish diplomatic or consular mission.

The main difference between a Schengen visa and a national visa is the period for which it is issued. And so, a Schengen visa (marked with the symbol C) is issued when the planned stay in the territory of the Member States of the Schengen area does not exceed 90 days during each 180-day period.

A national visa (long-term visa, marked with the symbol D) entitles to entry and continuous stay in the territory of the Republic of Poland or several consecutive stays, lasting in total longer than 90 days. The period of validity of a national visa may not exceed 1 year.

Visas typically intended for work in Poland are visas for which the purpose of issue has been marked as:

  • „05”- issued for the purpose of performing work for a period not exceeding 6 months within the next 12 months, on the basis of a declaration of intention to entrust work, registered in the poviat labor office;
  • „05b”- issued to perform seasonal work 270 days during a calendar year;
  • „06”- in order to perform work on the basis of documents other than the above-mentioned employer's declaration (applies mainly to foreigners intending to work on the basis of a work permit).

In order to extend your stay in Poland, you must submit an application for a temporary stay in Poland.

RESIDENCE CARD:

The residence card, during its validity period, confirms the identity of the foreigner during his stay in the territory of the Republic of Poland and entitles, together with the travel document, to multiple border crossings without the need to obtain a visa.

In addition, the residence card is a residence permit which entitles its holder to travel within the territories of other Member States of the Schengen area for a period not exceeding 90 days during each 180-day period.

A residence card is issued in several cases. The basis for obtaining it is the possession of:

  • Temporary residence permits,
  • Permanent residence permits,
  • International protection,
  • permission to stay for humanitarian reasons.

The validity period of the residence card varies depending on the basis for issuing it. A temporary residence card is issued for a maximum of three years.

A residence card issued on the basis of a permanent residence permit is valid for 10 years. If the basis is a long-term resident's residence permit, the card will be valid for 5 years.

The purpose of issuing a residence card depends on the purpose of the stay, e.g. work, business activity in Poland, studies, family reunification and others.

The procedure of legalizing temporary stay takes place in the voivodeship office - in the department competent for foreigners. An application for a temporary residence permit should be submitted to the voivodship office competent for the foreigner's place of residence, e.g. if the foreigner lives in Warsaw, the application should be submitted to the Mazowieckie Voivodship Office.

The stamp duty for examining the case of granting a temporary residence permit is PLN 340 or PLN 440 depending on the basis on which the application was submitted. The fee is refunded in the event of a negative decision at the request of the person.

In the event of a positive decision, you must pay an additional PLN 50 (or PLN 25 - reduced fee) for the issuance of a residence card.

POLE'S CARD:

The Pole's Card is a document confirming the foreigner's belonging to the Polish nation.

The condition for obtaining the Pole's Card is a declaration of belonging to the Polish Nation and the possession of citizenship of one of the countries of the former USSR. The Polish Card can therefore be granted to citizens of Armenia, Azerbaijan, Belarus, Estonia, Georgia, Kazakhstan, Kyrgyzstan, Lithuania, Latvia, the Republic of Moldova, the Russian Federation, Tajikistan, Turkmenistan, Ukraine or Uzbekistan.

The person applying for the Pole's Card should express their relationship with Poland through the knowledge of the Polish language and demonstrate the will to cultivate Polish tradition, culture and customs.

However, it does not mean granting Polish citizenship to a foreigner, granting the right of temporary or permanent residence in Poland, or the right to cross Polish borders without a visa.

However, having a Pole's Card is associated with certain rights; its holder may:

  • obtain a national visa entitling to multiple crossings of the Polish border free of charge;
  • submit an application for citizenship by the President of the Republic of Poland at the Polish consulate free of charge;
  • use the help of the consul, within his competence, in a life-threatening or safety-related situation;
  • undertake legal work in Poland without the need for a work permit;
  • run a business in Poland on the same terms as Polish citizens;
  • in Poland, use the free education system at the primary, secondary and tertiary level on the same terms as Polish citizens, and at the same time apply for scholarships and study aid intended for foreigners studying and studying in Poland;
  • in emergencies, use free healthcare in Poland on the same terms as Polish citizens;
  • use a 37% discount on rail travel in Poland;
  • visit state museums in Poland for free;
  • first of all, apply for funds from the Polish state budget or from the budget of local governments of communes in Poland intended for supporting Poles abroad;
  • submit an application for a permanent residence permit free of charge;

Citizens of the Member States of the European Union and the European Economic Area, as well as Swiss citizens

Contrary to foreigners from the so-called third countries (not belonging to the EU or EEA) - enjoy a privileged status in terms of the possibility of legally undertaking work in Poland, which results from the free movement of workers within the EU / EEA area.

Such foreigners do not need a work permit. They are also not covered by the obligation to obtain a visa or a temporary residence permit in Poland (confirmed with a residence card).

If a foreigner intends to stay in Poland for more than 3 months, he must register the stay of the EU citizen in Poland.

The application for registration of the stay of a citizen of the European Union is submitted in person to the voivode competent for the place of stay not later than on the day following the lapse of 3 months from the date of entry into the territory of the Republic of Poland. The above period does not apply to an EU citizen who has entered the territory of Poland in order to look for a job, in his case this period is not longer than 6 months, unless after this period he proves that he actively continues looking for a job and has real chances for employment.

Such a certificate of registration of an EU citizen's residence is issued for 10 years.
